DISTANCE SALES AGREEMENT

This Distance Sales Agreement (“Agreement”) is executed between Laykapet.shop (“Seller” or “We”) and the consumer (“Buyer” or “You”) who purchases goods or services through the website (“Site”). This Agreement has been prepared in accordance with the Consumer Protection Law No. 6502 (“TKHK”) and the Regulation on Distance Contracts (“Regulation”), and it sets forth the terms and conditions applicable to the sale and delivery of the ordered goods or services.

By placing an order or making a payment through the Site, the Buyer is deemed to have accepted all the terms of this Agreement.

2. Subject of the Agreement

This Agreement regulates the rights and obligations of both parties regarding the sale and delivery of the goods or services ordered electronically by the Buyer through Laykapet.shop.

The Buyer acknowledges that they have read and understood the essential features of the product/service, the sales price, payment method, delivery conditions, and their right of withdrawal, and has confirmed them electronically.

3. Term and Performance of the Agreement

  • Agreement Date: This Agreement comes into effect on the date the Buyer confirms the order.
  • Delivery Time: Unless otherwise agreed, the ordered product shall be delivered to the Buyer or the designated recipient within [X] days from the date the order is received by the Seller.
  • Delivery Method: The Seller will ship the product via a contracted courier or logistics service provider. If the Buyer is not available at the provided address at the time of delivery, the Seller will be deemed to have fulfilled its obligation. The Seller is not responsible for any losses or additional costs resulting from the Buyer’s failure to receive the order on time or at all.

4. Payment Terms

  • Payment Method: The Buyer may choose from available payment methods (credit card, bank transfer, etc.) on the Site.
  • Interest & Late Fees: In installment purchases, late payment interest will be applied in accordance with the Bank Cards and Credit Cards Law and related regulations.
  • Price Validity: Prices and promotions displayed on the Site remain valid until updated or changed. Discounts and offers remain valid until the end of the promotional period.

5. Right of Withdrawal

  • Withdrawal Period: The Buyer has the right to withdraw from the Agreement within 14 days without providing any reason and without incurring any penalty. The withdrawal period starts from the date the product is delivered to the Buyer or the designated third party.

Exceptions:

The right of withdrawal does not apply to:

  • Products prepared upon special request or tailored to the personal needs of the Buyer.
  • Items that cannot be returned due to their nature, perishability, or expiry risk.
  • Hygiene-related products such as opened cosmetics, personal care items, or underwear if the protective seal has been broken.
  • Other non-returnable items as specified under TKHK and applicable regulations.

Notification Process:

To exercise the right of withdrawal, the Buyer must notify the Seller in writing or via a permanent data storage medium (e.g., an email to [email protected] or a return request via the Site) within the withdrawal period.

Return Process:

Upon exercising the right of withdrawal, the Buyer must return the product to the Seller within 10 days from the date of delivery. The product must be returned undamaged, complete, in its original packaging, and accompanied by the original invoice.

Refund & Costs:

If the withdrawal is valid, the Seller will refund the full payment, including any shipping fees, within 14 days using the original payment method. Unless otherwise stated, the return shipping costs are covered by the Seller.

6. Additional Return & Exchange Policies

Apart from the statutory right of withdrawal, the Seller may provide additional return and exchange rights based on its commercial policies or regulatory requirements. 7. Dispute Resolution

For disputes arising from this Agreement:

  • If the claim is within the financial limits set by the Ministry of Trade, the Buyer may apply to the Consumer Arbitration Committees in their place of residence or where the transaction took place.
  • If the claim exceeds the limit, the Consumer Courts have jurisdiction.

8. Privacy & Data Protection

9. Effective Date

This Agreement enters into force electronically on the date the Buyer confirms the order. By placing an order, the Buyer declares that they have read, understood, and accepted all the terms of this Agreement.

10. Other Provisions

  • Modifications: The Seller reserves the right to update or modify the Agreement as required by regulatory changes or operational needs.
  • Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force.
  • Acknowledgment: The Buyer confirms that they have read and understood this Agreement, along with any related terms, including the Preliminary Information Form and the Refund and Return Policy.
